FOMO's service and processing fees are NON-REFUNDABLE under any and all circumstances without exception.

Section 1

All Sales Are Final

All ticket purchases made through the FOMO platform are final and non-refundable by default. By completing a purchase, you expressly acknowledge and agree that:

Section 2

FOMO Service Fees — Strictly Non-Refundable

2.1 What FOMO Fees Cover

FOMO charges a service and processing fee for each transaction. This fee covers the cost of operating the platform, providing the ticketing infrastructure, payment processing, customer support, email delivery, and related services.

FOMO's service and processing fees are non-refundable under any and all circumstances, including but not limited to:

This non-refundability applies regardless of who initiates the refund request or what the underlying circumstances may be. The service fee is earned by FOMO at the moment the transaction is processed.

Section 3

Event Cancellation by Organizer

3.1 Organizer's Sole Responsibility

If an Organizer cancels an event for any reason — including but not limited to low ticket sales, logistical issues, force majeure, or personal reasons — the Organizer is solely and exclusively responsible for:

FOMO is not a party to the transaction between the Buyer and the Organizer with respect to the ticket price. FOMO has no obligation and accepts no liability to refund the ticket price on behalf of an Organizer. FOMO shall not be held responsible for an Organizer's failure or refusal to issue refunds.

3.3 Organizer Agreement

By listing an event on FOMO, Organizers expressly acknowledge and agree that:

3.4 Postponed or Modified Events

If an event is postponed, rescheduled, or significantly modified (including changes to date, time, location, or format), the Organizer is responsible for notifying all Buyers. Refund eligibility for postponed or modified events is at the Organizer's sole discretion. FOMO is not obligated to intervene and assumes no liability for any resulting Buyer dissatisfaction.

Section 4

Chargebacks and Payment Disputes

4.1 Unauthorized Chargebacks

Filing a chargeback with your bank or payment provider for a valid, completed purchase — without first contacting FOMO — constitutes a violation of these Terms. FOMO reserves the right to permanently ban any account associated with a fraudulent or unwarranted chargeback and to pursue recovery of the disputed amount plus associated fees.

4.2 Legitimate Fraud Claims

If you believe a transaction was made fraudulently on your account without your authorization, you must: (1) immediately contact FOMO at support.fomo@gmail.com, and (2) contact your bank or payment provider. FOMO will cooperate in the investigation but makes no guarantee of outcome.

4.3 FOMO Fee in Chargeback Scenarios

Even if a chargeback is successful for the ticket price portion of a transaction, FOMO's service fee remains non-refundable and FOMO may seek recovery of that amount through available legal remedies.

Section 5

Technical Errors and Duplicate Purchases

If you believe you were charged more than once for the same ticket due to a verified technical error on FOMO's platform, contact support.fomo@gmail.com within forty-eight (48) hours of the transaction with proof of the duplicate charge. FOMO will review the claim at its sole discretion and, if a duplicate charge is confirmed, will issue a refund of the ticket price for the duplicate transaction. FOMO's service fee will not be refunded even in the case of a confirmed duplicate charge.

FOMO is not responsible for double purchases made due to user error, slow internet connections, multiple clicks, or actions on the user's end.

Section 6

How to Request a Refund

6.1 For Organizer Cancellations

Contact the Organizer directly. The Organizer's contact information should be available on the event listing. FOMO is not obligated to mediate refund disputes between Buyers and Organizers, but may do so at its discretion.

6.2 For Technical Errors

Email support.fomo@gmail.com with the subject line "Refund Request — [Order ID]" and include:

FOMO will review refund requests within five (5) to ten (10) business days. Submitting a refund request does not guarantee a refund will be issued. FOMO's determination is final.

Section 7

Payment Processing Terms

7.1 Payment Methods

FOMO currently accepts payments via PayPal. FOMO does not accept cash, bank transfers, or any other payment method not explicitly offered at checkout. The availability of payment methods may change at any time without notice.

7.2 Payment Security

FOMO does not store, transmit, or have access to your payment card details. All payment information is handled directly by the applicable third-party payment processor. FOMO is not liable for any data breach, unauthorized transaction, or security incident occurring at the payment processor level.

7.3 Failed Payments

If a payment fails to process, no ticket will be issued and no reservation will be held. FOMO is not responsible for tickets selling out during the time a payment was being retried or re-attempted.

7.4 Pricing Accuracy

FOMO takes reasonable steps to display accurate pricing. In the event of a pricing error, FOMO reserves the right to cancel the transaction and issue a full refund of all amounts paid, including any FOMO fees, at its sole discretion.

Section 8

Governing Law

This Refund and Payment Policy is governed by the laws of the Republic of Costa Rica. Any disputes arising from this Policy shall be subject to the exclusive jurisdiction of the competent courts of Costa Rica, unless otherwise agreed in writing.

This Policy forms part of and must be read together with FOMO's Terms and Conditions, which are incorporated herein by reference.

Section 9

Changes to This Policy

FOMO reserves the right to amend this Refund and Payment Policy at any time. Updates will be posted on the platform with an updated effective date. Continued use of the platform following any changes constitutes your acceptance of the revised Policy. Purchases made prior to the effective date of any change shall be governed by the Policy in effect at the time of purchase.
